Patent rights are territorial. International filing procedures can help applicants seek protection in multiple jurisdictions, but they do not create a single worldwide patent.
International Patent Protection for Utility, Plant, and Design Inventions
A Patent Cooperation Treaty (PCT) application provides an international filing procedure for seeking patent protection in participating countries. Eligible applicants may file through a competent receiving Office, including the USPTO or WIPO.
A PCT application does not create a worldwide patent. Applicants must meet the applicable national or regional phase deadlines and requirements. Each national or regional patent Office decides whether to grant protection under its own law.
The Hague System allows eligible applicants to seek design protection in designated participating jurisdictions through one international application. Applications may be filed directly with WIPO or, when the requirements are met, indirectly through the USPTO. Protection remains subject to each designated jurisdiction’s law and examination requirements.
