Trademark Intake Disclosure Form Purpose
Simply put, the trademark disclosure form is used to explain the mark for intake into the steps to seek trademark protection.
We tell our clients that the most important thing when working with a trademark attorney is to be sure that the one you work with understands your intentions and has experience filing trademark registration applications.
How We Use the Information
We use the answers to the questions on the disclosure form to begin our understanding of the mark and guide our discussions and next steps. The responses to the questions are related to all 4 of our steps to trademarking.
Our 5 Trademark Intake Questions
The trademark disclosure process is easy. The following are the questions that are presented on our fillable trademark disclosure form. The form can be opened and edited. There is no requirement to provide a response to a question if it is not applicable to your mark or the mark’s circumstances. You can skip any question, or preferably, enter “not applicable” and explain why the question is not applicable.
- What type of mark would you like to register? (Logo, Name, Slogan, Audio-clip)
- Are you currently advertising with the trademark? In which ways?
- How long have you been advertising using the trademark?
- Do you have any other registered trademarks?
- Do you want protection in other countries? Which countries?
Also we will need the following if applicable:
- A copy of the trademark showing it as desired to be registered.
- A photo or scan showing evidence of using the trademark in commerce on your goods/services.
How to Best Use the Invention Disclosure Form
First, Download the Form
The first thing to do is get your copy of the trademark disclosure form downloaded. There is a button below with a link that will open a new tab and download the form. It is the recommended best practice from our entrepreneur and inventor clients to save a copy and then complete it with as much detail as possible.
Second, Answer All Questions with as much Detail as You Can
The second thing to do is enter information about your trademark. There are no limits on the length of text entry fields in the trademark intake form. If more content is entered in any section, that section will scroll to enable viewing of the contents. You cannot over-disclose. The more description and detail provided, the better.
Third, Send the Completed Form and Any Media
The last thing to do is send us the completed form and the following as applicable:
- A copy of the trademark showing it as desired to be registered.
- A photo or scan showing evidence of using the trademark in commerce on your goods/services.
