What is a patents professional? At its most basic it is a USPTO Registered Patent Practitioner. It is a licensed professional person who practices in patentability studies and patent application writing. Patentability is: (a) whether an idea or invention exists in the prior art, or, (b) whether an invention or idea conflicts with another invention or idea. Looking for a Patent Agent (Attorney Lawyer Firm Office) to help? We offer complete patenting research services – from our patent law firm office for your invention or idea. We offer patenting services for all types and kinds of patent applications. Provisional and Non-Provisional applications. Utility patents. Design patents. Plant Patents. US and International (PCT) applications.
Patent Search. Prior Art Search. A search to find out whether there are products and inventions similar to an idea for an invention that you want to patent. For instance, prior to applying for a patent.
Novelty Search. Patentability Search. A search to find out whether an invention is new and patentable. For instance, before the inventor files a patent application.
Important TIP: proper searching can reduce or eliminate potential rejections and objections. As a result, proper searching saves money. This is because it results in two things. Firstly, better (more complete) writing for the specification part of the patent application. And, secondly, thorough preparation for potential office actions.
Patentability Study. Patentability Determination with Report and Consultation. This is a determination as to whether an invention is patentable.
Clearance Study. Clearance Determination with Report and Consultation. This is a determination as to whether a product or activity will infringe any valid or enforceable patent claims. A clearance study is also called a Freedom to Operate Study.
Opposition Study. Opposition Determination with Report and Consultation. This is a determination as to whether the oppositions patent or activity is valid or enforceable in view of your invention or activity.
Validity Study. Validity Opinion with Report and Consultation. This is a determination as to whether a patent is valid or enforceable.
What is Patent Application Writing and Drafting? It is the writing, editing, and preparing the specification, claims, and drawings for an application.
Important TIP: The drawings, diagrams, and flowcharts necessary for a patent application must be in proper form. Both USPTO and International Patent Applications require drawings where the invention “admits of illustration.”
If the inventor does not have drawings that are compliant with the submittal requirements of the USPTO, we can edit or arrange new ones. Note, however, new drawings may incur a minimal additional charge.
What is Patent Application Filing? It is the submitting of all the documents and information needed for an application to the patent office.
What is Patent Prosecution? It is representing your invention before the USPTO. It is the conducting of communications with the USPTO regarding the examination of a patent application, or a patent. Most frequently it is things like, letters to address any rejections or objections made regarding a patent application, amendments to add new or revised claims, or the conducting of examiner interviews.
