The validity of claims or opposition opinion is based on the patent practitioners examination of the prior art in comparison with the patent in question. The opinion is also based on what would be known to a person having ordinary skill in the art at the time the patent application was filed.
These kinds of opinions can be sought by either the patent owner or any other person or company who has an interest in the claims of the patent.
