International Patenting Available

Inventor Tip: While there is no such thing as an international patent, there is patenting on the international stage. All three kinds of patents (utility, design and plant) have international patenting processes that can be very beneficial.

International Utility and Plant Patenting Starts with a PCT Application

Our team can help with patenting your invention all around the world. One of the choices available for filing a complete and proper utility or plant patent application is to file a Patent Cooperation Treaty (PCT) application with the World Intellectual Property Organization (WIPO). The PCT application can be filed directly into WIPO or indirectly through the USPTO. We offer both options, but we recommend that American inventors file PCT applications through the USPTO. Additionally, we also recommend selecting the United States as the International Search Authority unless the specific circumstances necessitate otherwise.

A complete and proper PCT patent application that is properly submitted to WIPO results in the invention being patent pending worldwide. The same is true when the application is submitted to the USPTO, and they transmit it to WIPO. Importantly, the PCT is a two stage patent application process that also requires a patent application in each country where you wish to seek patent protection.

There is no international patent. Patents are issued and controlled on an individual country basis. An application connected to the PCT must be filed individually in each country where protection is sought. The PCT is only an international patent pending application. Read more about the PCT.

International Design Patenting Includes a Hague Application

Our team can help with seeking design (industrial design) patent protection for your unique ornamental design or industrial design in the United States and internationally. One of the choices available for filing a complete and proper design patent application is to file an international industrial design patent application, called a Hague application with WIPO.

The Hague application is filed directly into WIPO. The Hague application cannot be field at the USPTO, but a design patent that is from or connected to the application at WIPO can be issued if allowable. Unlike the PCT, Hague applications permit you to register for multiple patents in multiple countries in a single application.
